Welcome to the Cook Islands Specialist Programme - North America Platform (the "Platform"), hosted via Thinkific. This Platform is owned and operated by or on behalf of the Cook Islands Tourism Marketing Corporation ("we," "us," or "our").
By creating an account, accessing, or using our training platform, including any associated courses or pages, you ("User," "Student," "Travel Agent," or "Advisor") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not create an account or use the Platform.
1. Eligibility, Scope, and Program Evolution
- B2B Purpose: This Platform is intended strictly for professional travel agencies, travel advisors, and industry partners seeking to enhance their knowledge of the Cook Islands. It is not intended for consumer use.
- Global Access: These Terms apply globally to all users. Specific provisions for users operating within the United States of America (USA) and Canada are outlined in Section 9.
- Program Evolution & Modular Courses: The core curriculum is hosted on the Cook Islands Specialist Programme - North America Platform. By agreeing to these Terms, you acknowledge that this programme consists of multiple modules and courses. We reserve the right to roll out, update, modify, or add new courses to this programme over time at our sole discretion. Your enrollment in any current or future courses under this programme remains subject to these Terms.
2. Certification and Program Benefits
- Certificate of Completion: Upon successful fulfillment of all curriculum criteria, quizzes, and requirements for a designated course within the programme, students will be issued a digital Certificate of Completion.
- Limitations: This certificate serves as a recognition of training completion for professional development. It does not constitute a formal academic degree, legal accreditation, or a commercial partnership agreement. We reserve the right to withhold or revoke a certificate if fraudulent activity or a breach of these Terms is detected.
3. Account Registration and Security
- To access the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration.
- You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
- Accounts are individual. Sharing account credentials with other agents, agency staff, or third parties is strictly prohibited.
4. Intellectual Property Rights
- All materials on this Platform—including text, graphics, videos, quizzes, logos, brand guidelines, and marketing assets—are the intellectual property of the Cook Islands Tourism Marketing Corporation or its licensors and are protected by international copyright and trademark laws.
- Limited License: Upon enrollment, you are granted a limited, non-exclusive, non-transferable, revocable license to view the course content for your professional training.
- Permitted Use: You may use the information acquired to promote and sell travel to the Cook Islands to your clients, utilizing official assets provided via our main trade portal at cookislands.travel.
- Prohibited Use: You may not modify, reproduce, distribute, sell, lease, or create derivative works of the course curriculum, quizzes, or platform content without express written consent from us.
5. Third-Party Links and Platform Hosting
- Thinkific: This training platform is hosted by Thinkific Labs Inc. Your interactions with the technical architecture of the platform are subject to Thinkific’s standard infrastructure policies.
- External Links: The Platform contains links to external websites, primarily our main destination website, cookislands.travel. We are not responsible for the content, privacy practices, or availability of external third-party sites.
6. Disclaimer of Warranties
- The Platform and its contents are provided on an "as-is" and "as-available" basis. While we strive to provide accurate, up-to-date travel insights, itineraries, and geographic data, we make no warranties, express or implied, regarding the completeness, accuracy, or reliability of the information.
- Travel conditions, airline schedules, and local regulations change frequently. Travel agents are responsible for verifying actual travel logistics independently prior to client bookings.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Cook Islands Tourism Marketing Corporation, its directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, this training platform or reliance on the information taught on the Platform.
8. Termination of Access
We reserve the right, at our sole discretion, to suspend or terminate your account and access to any or all courses within the platform at any time, without notice, for conduct that we believe violates these Terms, harms our brand reputation, or infringes upon intellectual property.
9. Specific Jurisdictions: USA and Canada
A. For United States Users
- DMCA Compliance (Copyright Infringement): If you believe that any material on our platform infringes upon a copyright that you own or control, you may file a notification of such infringement with our designated agent under the Digital Millennium Copyright Act (DMCA).
- Governing Law & Dispute Resolution: For users registering from the United States, these Terms shall be governed by and construed in accordance with the laws of the Cook Islands, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in competent courts, and the parties hereby consent to the personal jurisdiction and venue therein.
B. For Canadian Users
- Privacy and CASL Compliance: We respect Canadian privacy principles. Any personal information collected during registration is processed in accordance with our Privacy Policy. By signing up, you agree to receive transactional emails regarding your course progress and certificates. Any promotional emails regarding market campaigns or toolkits will comply with Canada’s Anti-Spam Legislation (CASL), and you may unsubscribe at any time.

10. Amendments to Terms
We reserve the right to modify these Terms of Use at any time. Any changes will be posted directly to this URL (www.cookislandstourismtraining.com/pages/terms). Your continued use of the platform or enrollment in newly rolled-out modules after updates are posted constitutes your acceptance of the revised Terms.
